FIREWORKS PURCHASING AND HOLD HARMLESS AGREEMENT:

The undersigned hereby acknowledges:

A) that he/she is of legal of age to purchase fireworks in his/her home state;

B) that the fireworks being purchased have hazardous properties that may endanger life and limb; and

C) that he/she is legally entitled to receive these fireworks. In consideration for the sale of the above fireworks to the undersigned, the undersigned agrees as follows:

1. SkylighterFireworks.com (the seller) makes no warranty that the fireworks are merchantable or that they are fit for a particular purpose.

2. In no event shall the seller, or seller's heirs and assigns, be liable for consequential damages, nor shall seller's liability on any claim for damages arising out of or connected with the sale, delivery, or use of the fireworks exceed the purchase price of the fireworks.

3. The undersigned will not use the fireworks in violation of any local, state, or federal law.

4. The undersigned, on behalf of the undersigned, his/her successors and assigns, agrees to hold the seller harmless from and will indemnify seller from damages caused by the use of the fireworks.

5. The undersigned agrees that if his/her order from us cannot be delivered for any reason (wrong address, refused delivery, failure to pick up at trucking company terminal, etc.), that he/she will pay for any return shipping and storage costs we may have to incur, plus a 20% (of total order invoice) restocking fee. Seller agrees to credit or refund undersigned for items not delivered received in resellable condition, minus any return shipping costs and a 20% restocking fee.

6. The undersigned agrees that the conditions above apply equally to all current, past, and future purchases from SkylighterFireworks.com.
